These Terms of Service govern your use of the XPMaps websites, web platform, mobile applications, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms and our Privacy Policy.
You must be at least 18 years old and legally able to enter into these Terms. If you use XPMaps for a company or other organization, you represent that you are authorized to bind that organization and to provide the information submitted through its account.
XPMaps provides tools for route and trip planning, cost estimation, permit and compliance workflows, fleet and dispatch management, trip documents, driver navigation and tracking, communications, and related transportation operations. Features may vary by account, role, platform, location, and service plan.
You are responsible for accurate account information, protecting your credentials, and activity performed through your account. Organization administrators control membership, roles, trip assignments, and access to organization data. You must promptly notify us of suspected unauthorized access and remove access for people who no longer belong to your organization.
Driver navigation and tracking features may require precise foreground and background location. When enabled, location may continue to be collected during active trip tracking while the app is minimized or the screen is off and may be visible to authorized account administrators, managers, and dispatchers. Drivers must obey traffic laws and use the mobile app only when it is safe and lawful to do so. Do not type, review complex information, or otherwise interact with the app while driving. XPMaps is not an emergency service, an autonomous-driving system, or a substitute for an electronic logging device, professional dispatch judgment, official road signs, law-enforcement instructions, or government-issued permits.
Organizations that assign drivers or monitor their location are responsible for providing legally required notices, obtaining any required consent, and using location information in accordance with employment, privacy, and transportation laws.
You are responsible for verifying all submitted route, vehicle, axle, dimension, weight, cargo, company, driver, date, and contact information. You must review prefilled, imported, calculated, or duplicated values before relying on them. Incorrect or incomplete information can produce an unsuitable route, compliance result, permit estimate, or payment amount.
Routes, state mileage, restrictions, permit requirements, escort requirements, travel windows, and costs shown by XPMaps are planning estimates based on available data and the information submitted. They are not guarantees. Government agencies may prescribe a different route, requirement, fee, or schedule, and road or regulatory conditions may change without notice.
Before operating a vehicle, you are responsible for confirming the approved route, carrying all required permits and documents, and complying with current laws, posted restrictions, permit conditions, and instructions from authorities. A displayed estimate or route does not itself authorize travel.
Prices may include estimated government fees, XPMaps service fees, and other disclosed amounts. Final government charges may differ from estimates. Depending on your account, payment may be prepaid, authorized for later capture, charged to a stored payment method, deducted from an account balance, or invoiced under an approved billing arrangement. You authorize applicable charges and remain responsible for valid amounts incurred through your account.
You retain ownership of information, messages, and files you submit. You grant XPMaps a limited right to host, process, reproduce, and transmit that content as needed to provide, secure, support, and improve the Services and to complete requested trip, permit, payment, or compliance workflows. You must have the right to upload and share the content and must not submit unlawful, misleading, malicious, or infringing material.
You may not misuse the Services, bypass access controls, access another account without authorization, interfere with platform operation, submit false compliance information, probe or reverse engineer protected systems except where law expressly permits it, upload malicious code, or use the Services to violate law or the rights of others.
The Services rely on third-party providers for functions such as authentication, mapping, routing, geocoding, payments, communications, storage, and app distribution. Their services may be subject to separate terms and may occasionally be unavailable or change. XPMaps is not responsible for third-party services outside our reasonable control.
We may maintain, update, add, remove, or modify features and may suspend access when reasonably necessary for security, legal compliance, nonpayment, misuse, or protection of users and the Services. We do not guarantee uninterrupted or error-free availability.
XPMaps and its software, design, branding, and platform content are owned by XPMaps or its licensors and are protected by applicable intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services for their intended business purpose while your account remains authorized.
To the extent permitted by law, the Services are provided "as is" and "as available." XPMaps disclaims implied warranties that may lawfully be disclaimed. To the extent permitted by law, XPMaps is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits or data, or losses caused by inaccurate user inputs, government decisions, road conditions, third-party services, unsafe device use, or operation contrary to an approved permit or applicable law.
Nothing in these Terms excludes liability that cannot legally be excluded or limits rights that applicable law does not allow you to waive.
You may stop using the Services at any time and may request account deletion by contacting us. XPMaps may suspend or terminate access for a material breach, unlawful use, security risk, or nonpayment. Data handling after termination is governed by our Privacy Policy and applicable retention obligations.
We may update these Terms as the Services or legal requirements change. We will post the updated version and revise the date above. Continued use after an update takes effect constitutes acceptance where permitted by law; additional notice or consent will be provided when required.
